A federal judge has blocked a new Kansas law that would strip federal family planning funding from a Planned Parenthood chapter in the state, reports the Associated Press.

The ruling was issued this morning by U.S. District Judge J. Thomas Marten.

“Planned Parenthood of Kansas and Mid-Missouri had argued that it would have suffered irreparable harm if a temporary injunction were not issued,” reports AP.

Planned Parenthood argued that the provision unconstitutionally imposes additional conditions of eligibility for a federal program that are not required by federal law and contended that as a result of the law it would be forced to close one or more clinics and raise fees.

The state claimed public agencies could handle those patients, though little evidence exists to show that is the case.

The state argued that an injunction would unconstitutionally replace the state’s discretion with the court’s judgment.

The judge apparently disagreed.
