Arkansas Insurance Coverage for Contraception Refusal Clause

Arkansas law allows certain employers and/or insurers to require that their plans exclude coverage for contraception.
Under the law, religious employers whose religious tenets prohibit use of prescription contraception may require issuers of its health-insurance plans to exclude coverage for contraception.
The law defines religious employer to mean an entity that:
- Is organized and operated for religious purposes and has received a section 501(c)(3) designation from the IRS;
- Has as one of its primary purposes the inculcation of religious values; and
- Employs primarily persons who share its religious tenets.
The law, enacted in 2005, does not provide an alternative for women to obtain contraception coverage.
