Arkansas Abortion Refusal Clause
This law was last updated on Dec 9, 2016
Arkansas law allows individuals and hospitals to refuse to provide abortion services.
No person may be required to participate in a medical procedure which results in the termination of a pregnancy. No hospital, hospital director, or governing board may be required to permit the termination of human pregnancies within its institution.
Refusal to participate in the procedure or permit the procedure to be performed may not be a basis for civil liability or other recriminatory action.
The law, enacted in 1969, does not require hospitals or individuals that refuse to participate to offer any notice or referrals to patients seeking abortion services.
