Planned Parenthood of Indiana and Kentucky v. Commissioner of Indiana State Department of Health (2016 – forced ultrasound)

The American Civil Liberties Union of Indiana filed a lawsuit in federal court in Indiana on behalf of Planned Parenthood of Indiana and Kentucky (PPINK) challenging the ultrasound provision of HB 1337, which requires women to obtain an ultrasound and receive informed consent information at least 18 hours prior to an abortion. Prior to the enactment of this provision, women were required to have an ultrasound prior to an abortion, but they could have it on the same day as the abortion.

Plaintiffs allege that the law imposes an undue burden on a woman’s right to choose and is unconstitutional.


On March 31, 2017, U.S. District Court Judge Tonya Pratt blocked the ultrasound provision of the law.

On July 25, 2018, a three-judge panel of the Seventh Circuit of Appeals affirmed the district court’s order.

On Aug. 20, 2020, Planned Parenthood of Indiana and Kentucky dropped the lawsuit. HB 1337 will go into effect Jan. 1.
