AB 160 would amend Wisconsin’s wrongful death statute to include personhood language. State law allows families to bring a wrongful death suit when a child dies as a result of a wrongful act or omission, or of medical malpractice.
AB 160 defines ”deceased minor” to include an unborn child who has died, and would define “patient” to include an unborn child. The bill defines “unborn child” as “a human being from the time of fertilization to the time of live birth.”
