SJR 12 proposes an amendment to the West Virginia Constitution to acknowledge legislative authority relating to the “protection of innocent life.”
The constitutional amendment would state that nothing in the Constitution secures or protects a right to abortion or requires the funding of abortion.
The amendment provides that the legislature may enact, amend, or repeal statutes regarding abortion including, but not limited to, circumstances of pregnancy resulting from rape or incest or when necessary to save the life of the pregnant person.
If passed, the amendment would be submitted to the voters of West Virginia during the 2018 election.
STATUS
Adopted by the senate on February 9, 2018, by a 25-9 vote.
Adopted by the house on March 5, 2018, by a 73-25 vote.
Will appear on the November general election ballot.

On November 6, 2018, voters approved the measure by a margin of 51.7 percent to 48.3 percent.
