HJR 125 is a joint resolution proposing a constitutional amendment relating to a person’s free exercise of religion.
Upon voter approval, the amendment would prohibit a government entity or homeowner’s association from burdening a person’s free exercise of religion unless the government proves that the burden is in furtherance of a compelling governmental interest and is the least restrictive means of furthering that interest.
Texas already has a RFRA in place. Current law states that the government may not “substantially burden” an individual or organization based on religious beliefs. This amendment goes further and states that the government “may not burden” in any way.
