Funding Restrictions for Family Planning, Human Embryo and Fetal Research, Insurance Coverage

H 4538 would prohibit federal and state funds from going to universities, hospitals, non-profit and state agencies that associate or provide any service related to abortion care, counseling or referrals. This would not apply to an abortion performed to save the life of the mother.

The bill would prohibit any public funds from being expended, paid, or granted to or on behalf of an existing or proposed research project that involves the performance of abortion, human cloning, or prohibited human research.

Under this bill the Department of Health and Environmental Control and local units of administration would be prohibited from utilizing state funds for the procurement of abortions or distribution of drugs classified as ’emergency contraception’ by the federal Food and Drug Administration.

A family planning contractor that receives any federal or state family planning funds and is found not to be in compliance with the requirements of this provision would be blocked from receiving any future federal and state family planning funds and would need to return to the State the full amount of federal and state family planning funds received.

The Department of Health and Human Service may fine a family planning contractor up to $1,000 for any violation.
