SB 805 would prohibit public funds (taxpayer funds and government salaries) from being used to pay for any activity that includes the licensing or support of same-sex marriage.

The bill would prohibit an employee of the state or local government entity from officially recognizing, granting, or enforcing a same-sex marriage license. No taxes or public funds of the state could be spent enforcing any court order requiring the issuance or recognition of a same-sex marriage license.

The bill would require the courts of the state to dismiss any challenge to any portion of the Preservation of Sovereignty and Marriage Act, with an award of costs and attorney fees to defendants.

An employee of the state or any local government entity that violates or interferes with this Act would no longer receive a salary, pension, or other employee benefit at the expense of taxpayers of the state.
