SB 817 would make it unlawful for anyone to perform or induce an abortion in the state of Oklahoma.
If passed, it would be considered an act of murder in the first degree to perform or induce an abortion after conception.
The bill defines “abortion” to mean:
[…]the use or prescription of any instrument, medicine, drug or any other substance or device to intentionally kill an unborn human being.
The bill defines “unborn human being” to mean:
[…]the offspring of human beings from the moment of conception until either live birth or death, including the human conceptus, zygote, morula, blastocyst, embryo and fetus, whether conceived or located inside or outside the body of a human female.
The bill does not provide an exception for pregnancies that are a result of rape or incest. The bill does not offer any protections for pregnant people that have a miscarriage. The language of the bill is so broad, that if passed, a pregnant person may also be charged with murder.
