Fetal Homicide, Later Abortion

Full Bill Text

S 2796 would amend current state law to permit a health-care practitioner to perform an abortion within 24 weeks from the commencement of pregnancy, or when there is an absence of fetal viability, or at any time when necessary to protect a patient’s life or health.

The bill would repeal Public Health Law section 4164, which requires an abortion after the 12th week of pregnancy to be performed in a hospital and only on an in-patient basis.

The bill would repeal Subdivision 8 of section 6811, which makes it a misdemeanor to sell or distribute contraceptives to a minor under the age of sixteen years.

The bill would amend New York State Penal Law regarding homicide, abortion, and related offenses, to repeal sections which currently make it a felony or misdemeanor to have an abortion after 24 weeks.
