New York Parental Notification Bill (A 6125)

A 6125 would require physicians to provide written parental notice at least 48 hours before the performance of an abortion upon an unemancipated minor.
The parental notification would be required for any patient under the age of eighteen.
Parental notification may be waived if:
- a medical emergency exists;
- the person or persons who are entitled to notice certify in writing that they have been notified; or
- the minor objects and obtains an order issued by a judge.
The bill would prohibit a parent, guardian or other person from coercing a minor to undergo an abortion.
Any person that knowingly performs or attempts to perform an abortion on a minor without first providing parental notification would be guilty of a misdemeanor and subject to civil liability.
The bill also includes the procedures needed to obtain an order waiving parental notification of an abortion.
