A 3040 would amend current legislation and require physicians to provide written parental notice at least 48 hours before the performance of an abortion upon an unemancipated minor.

The written notice would need to be addressed to the parent or guardian at the usual place of residence and delivered personally or via certified mail to the parent or guardian by the physician or an agent.

The bill states that parental notification may be waived if:

  • a medical emergency exists;
  • parents or guardians certify they have already been notified; or
  • a judge issues an order to waive the parental notification requirement.

Any person who knowingly or intentionally performs an abortion without meeting the requirements would be guilty of a misdemeanor and subject to civil action.

A 3040 establishes circumstances and procedures for proceedings to obtain an order waiving such parental notification.
