A 1705 would require a person wanting to donate cadaveric fetal tissue following an abortion procedure to provide written informed consent. Prior to written consent, the physician performing the abortion would be required to inform the person donating the fetal tissue if the procedure would alter the “nature, performance, or timing” of the abortion.
A physician that fails to provide this information would be guilty of a crime of the fourth degree, punishable by imprisonment up to 18 months and/or a $10,000 fine.
