Full Bill Text

A 495 would require that a patient desiring an abortion be “offered an opportunity” to undergo an ultrasound or sonogram and view the ultrasound or sonogram image of the embryo or fetus.

Forced Waiting Period

The bill would require that the ultrasound or sonogram examination be performed within 48 hours of a referral by a physician for an abortion, or not less than 48 hours prior to an abortion procedure being performed, whichever is later.

The bill would also require that any health irregularity disclosed by the ultrasound or sonogram that might endanger the health or safety of the patient be disclosed to the patient not less than 24 hours prior to the scheduled abortion procedure.

The ultrasound requirement would not apply if a medical emergency exists, in which case the physician would be required to certify the specific medical condition that constitutes the emergency and include the certification in the patient’s medical file.

The bill would require the Department of Health and Senior Services shall develop and distribute a form by which physicians must verify within 14 workdays that the patient was offered an opportunity to undergo an ultrasound or sonogram and view the ultrasound or sonogram image prior to the abortion procedure being performed.

The bill provides for civil penalties.
