A 774 would upgrade offenses involving the unlawful use of controlled substances or certain prescription drugs if the user is pregnant.

This bill provides that a person who uses any dangerous controlled substance or certain prescription drugs while pregnant would be guilty of a crime of the fourth degree. A crime of the fourth degree is generally punishable by a term of imprisonment of up to 18 months or a fine up to $10,000, or both.

STATUS

Identical to A 3437, which failed to pass in 2015.
