SB 394 recognizes out-of-state marriages for same-sex couples living in New Hampshire. The law assures that any same-sex couple who married outside of New Hampshire have valid marriages, regardless of where they lived at the time of the marriage and that the date the marriage was solemnized will be considered the beginning date of the marriage.
With this law, couples that have a civil union in another state and want to get married in New Hampshire will no longer be required to dissolve their civil union before they are allowed to marry in New Hampshire.
SB 394 also establishes that all family, marriage and divorce laws apply equally to same-sex and different-sex couples, regardless of any gendered language that is in the law.
STATUS
Signed into law by Gov. Hassan and went into effect on July 10, 2014.
