Full Bill Text
SB 100 would require a person performing an abortion on a pregnant person to first inform the patient of the opportunity to view an active ultrasound and ultrasound images, and listen to the fetal heart tone of the fetus.
The bill would require a person performing an abortion on a pregnant person or that person’s agent to inform the pregnant person of the opportunity to:
- view an active ultrasound of the fetus;
- view an ultrasound image of the fetus; and
- listen to the fetal heart tone of the fetus, if audible.
This would not apply to a procedure performed with the intent to:
- save the life of the pregnant person;
- prevent a serious risk of causing the pregnant person substantial and irreversible impairment of a major bodily function; or
- remove an ectopic pregnancy.
The pregnant person would need to provide written certification acknowledging that they were offered such opportunity and indicate whether or not they accepted.
A person who performs or attempts to perform an abortion in violation would be subject to a civil penalty of $1,000.
