Montana Referendum on Unborn Victim of Violence Act (HB 638)

HB 638 would have amended criminal statutes related to homicide to include acts against an “unborn child.” The bill would have made an offense a “deliberate homicide” if someone knowingly caused the death of an unborn child, or if they attempted any other forcible felony and ultimately caused the death of an unborn child.
The bill would have made an offense a “mitigated deliberate homicide” if a person caused the death of an unborn child, but did so under extreme mental or emotional stress.
The bill was meant to be submitted to the Montana electorate on the ballot at the general election in November, 2014.
