Full Bill Text
SB 98 would require that all school restrooms, locker rooms, and shower rooms accessible for use by multiple students to be designated for and used by male or female students only.
The bill defines “biological sex” to mean the physical condition of being male or female, which is determined by a person’s chromosomes, and is identified at birth by a person’s anatomy and indicated on their birth certificate.
The bill provides for alternative accommodations for students who assert that his or her gender is different from his or her biological sex and can provide written parental consent. Such accommodations would include but not be limited to single-stall restrooms, access to unisex restrooms, or controlled use of faculty restrooms, locker rooms, or shower rooms.
If passed, a transgender student may be forced to out themselves to their parents if they want to use alternative accommodations.
Related Legislation
Companion bill to HB 745.
Similar to HB 2303 and SB 720, both of which failed to pass in 2016.
