Full Bill Text

HB 5086 would prohibit an individual from receiving any type of compensation for fetal tissue donation. The bill would make it illegal to:

Financially benefit from or receive any type of compensation for the distribution or transfer of any portion of an embryo, fetus, or neonate including any organs, tissues, or cells that were obtained as the result of an elective abortion.

An “elective abortion” would not include:

  • The use or prescription of a device intended as a contraceptive;
  • The termination of a pregnancy to save the life of the mother; or
  • Treatment on a pregnant woman who is experiencing a miscarriage or has been diagnosed with an ectopic pregnancy.
