SB 449 would redefine the term “viability” under Maryland law to mean:
“that stage, beginning at 24 weeks’ gestation, when, in the best medical judgment of the attending physician, there is a reasonable likelihood of the fetus’s sustained survival outside the womb.”
Current Maryland law defines “viability” to mean:
“that stage when, in the best medical judgment of the attending physician based on the particular facts of the case before the physician, there is a reasonable likelihood of the fetus’s sustained survival outside the womb.”
