SB 5 would require the Department for Libraries and Archives to offer two separate forms for couples seeking marriage licenses. One form would provide for the entering of applicants’ names under sections titled “bride” or “groom,” while the second form would provide for the entering of applicants’ names under sections titled “first party” or “second party.”
SB 5 would also remove the statutory requirement that marriage licenses be signed by county (or deputy county) clerks, a provision already in effect due to Executive Order by Gov. Matt Bevin. If passed, this would simply codify the provision.
STATUS
This bill is in direct response to Rowan County Clerk Kim Davis and her refusal to sign marriage licenses for gay and lesbian couples.
