Informed ConsentFull Bill Text
SB 4 would amend current law regarding informed consent situations to further define what constitutes an “individual, private setting.”
This law would require a physician or a licensed nurse, physician assistant, or social worker to whom the physician delegates the responsibility to have a face-to-face meeting with the patient and would also require that both parties to be located in the same room for an informed consent to be valid. The private setting may also take place in real-time visual telehealth services initiated by the patient or physician.
STATUS
Signed by Gov. Bevin (R) on February 4, 2016.
