Kentucky Bill Prohibiting the Sale of Fetal Tissue (SB 61)

SB 61 would remove an exemption in the Uniform Anatomical Gift Act to prevent a person or organization from selling fetal tissue obtained from an abortion for profit.
Specifically, the bill would change the definition of the term “decedent.” Current law defies decedent as:
a deceased individual whose body or part is or may be the source of an anatomical gift. The term includes a stillborn infant and subject to restrictions imposed by law other than KRS 311.1911 to 311.1959, a fetus; [however, the term “fetus” does not include a blastocyst, embryo, or fetus that was the subject of an induced abortion]
SB 61 would remove the exemptions for the term fetus.
