Kansas Statutes Annotated section 65-1637 allows a pharmacist to refuse to fill or refill any prescription if in the pharmacist’s professional “judgment and discretion” such pharmacist is of the opinion that it should not be filled or refilled.

The law, enacted in 1953, does not require refusing pharmacists to provide notification or referrals to those seeking prescription services.
