Full Bill Text
HB 882 would provide for a private right of action for individuals upon whom abortions are performed in violation of existing state law, and for the wrongful death of the “unborn child.”
The bill would prohibit an abortion provider or the facility providing the abortion from obtaining a contractual waiver from the pregnant person concerning their or the “unborn child’s” private right of action.
An abortion provider found to have violated any existing law regarding abortion would be liable to pay to the plaintiff, in addition to any damages assessed, up to 50 percent of the liability for damages or $5,000.00, whichever is greater, and all reasonable attorney’s fees for the prosecution of the action.
