SB 734 would ban a physician from performing an abortion if the physician is aware that the pregnant person is seeking an abortion because it’s possible the fetus will be born with Down Syndrome.

The law prohibits a physician or other person from performing or attempting to perform an abortion if they know the pregnant person wants the abortion based on:

  • A test result indicating fetal Down syndrome;
  • A prenatal diagnosis of fetal Down syndrome; or
  • Any other reason to believe that a fetus has Down syndrome

Reporting Requirements

The director of a medical facility that performs abortions must maintain certain records. Under this bill, for each abortion performed, the physician must attest that they did not know that the pregnant patient was seeking an abortion, in whole or in part, because of any of the reasons mentioned above.
