Delaware Abortion Refusal Clause
This law was last updated on Nov 28, 2016
Del. Code Ann. Tit. 24, section 1791 allows individuals to refuse to perform or participate in medical procedures which result in the termination of pregnancy. The refusal of any person to perform or participate in these medical procedures may not be a basis for civil liability to any person, nor a basis for any disciplinary or other recriminatory action against the person.
Additionally, hospitals, hospital directors or governing boards may also refuse to permit the termination of human pregnancies within its institution, and the refusal to permit such procedures may not be grounds for civil liability or disciplinary action.
