HB 1068 makes it a felony for physicians to not offer medical care to a baby born alive after a failed abortion in late-term procedures. Failure to provide medical care is considered a Class 3 felony and comes with a $100,000 fine. Such a conviction will also be considered unprofessional conduct for medical licensing purposes.
Any person with knowledge of non-compliance compliance must report it to the state attorney general. Failure to report will be considered a Class 1 misdemeanor. The complainant’s identity and any other personally identifiable information will be kepy confidential.
The bill failed to pass out of committee on February 11, 2020.
