SB 1324 would have created a civil cause of action for damages that resulted from an unlawful termination of a pregnancy at any time prior to birth caused by intentional, knowing, or reckless conduct.

This bill would have amended the definition of “person” in the wrongful death statute to mean a “human being who had been born and was alive at the time of the act.”

This bill would not have given rights associated with personhood to a fetus at any time prior to a live birth.

This bill would have specified that a cause of action for the wrongful death of an unborn viable fetus does not exist against the mother or a health care practitioner performing an abortion permitted by law and for which required consent was given.
