HB 491 would require a physician to exercise the same degree of professional skill, care, and diligence to preserve the life and health of a child born alive after an attempted abortion as they would render to any other child born alive at the same gestational age.
A physician who fails to provide the appropriate medical treatment to a child born alive after an abortion would be charged with a Class B felony—punishable by at least 20 years in prison and a fine of at least $100,000.
A person who has knowledge of failure by a physician to comply with this provision would be required to report it to the state attorney general.
